Welcome to the Blaze Gym website of EK Essex Ltd. EK Essex Ltd T/A  Blaze Gym is pleased to make the websites located at BlazeGym.co.uk (e.g. www.BlazeGym.co.uk.co.uk,  (the “Sites”) available for your use and benefit. By using the Sites you agree to be bound by the Terms of Use set forth below. Use of the Sites is strictly voluntary. If you do not agree to these Terms of Use and the Privacy Policy, you must immediately log off the Sites and may not use the Sites.
 

These Terms of Use apply to your access to and use of the Sites and do not alter in any way the terms and conditions of any other agreement you may have with EK (Essex) Ltd T/A Blaze Gym, unless otherwise directed by EK (Essex) Ltd T/A Blaze Gym. If you breach any of these terms and conditions, your authorization to use the Sites automatically terminates and you must immediately discontinue use of the Sites.

ACCEPTANCE OF MEMBERSHIP
THE DECISION TO ACCEPT THE APPLICATION OF A POTENTIAL MEMBER SHALL BE AT THE SOLE DISCRETION OF BLAZE GYM. BLAZE GYM RESERVES THE RIGHT TO VERIFY, OR REQUIRE PROOF OF ALL INFORMATION GIVEN IN ORDER TO OBTAIN MEMBERSHIP AND ANY FRAUDULENT OR WRONGFUL INFORMATION GIVEN IN ORDER TO OBTAIN SUCH MEMBERSHIP COULD RESULT IN THE CANCELLATION OF ALL MEMBERSHIP RIGHTS AND LEAD TO THE REPAYMENT OF ALL MONIES DUE TO BLAZE GYM. IF THE MEMBERSHIP APPLICATION IS ACCEPTED BY BLAZE GYM, MEMBERSHIP OF BLAZE GYM BY THE APPLICANT SHALL COMMENCE AS STATED IN THE AGREEMENT. THE ACCEPTANCE OF AN APPLICATION FOR MEMBERSHIP OF BLAZE GYM SHALL CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN THE MEMBER AND THE CLUB. THE MEMBER HEREBY AGREES ALSO TO BE BOUND BY THE CLUB RULES, A COPY OF WHICH CAN BE PROVIDED BY ASKING AT RECEPTION.


PHYSICAL HEALTH OF MEMBER

THE MEMBER WARRANTS AND ALSO REPRESENTS THAT HE/SHE IS IN GOOD HEALTH AND IS NOT KNOWINGLY INCAPABLE OF ENGAGING IN EITHER ACTIVE OR PASSIVE EXERCISE. THE MEMBER FURTHER WARRANTS THAT SUCH EXERCISE WOULD NOT BE
DETRIMENTAL TO THEIR HEALTH, SAFETY, COMFORT, WELL-BEING OR PHYSICAL CONDITION.
BEFORE USING BLAZE GYM, THE MEMBER MUST FIRST READ A HEALTH COMMITMENT STATEMENT PROVIDED BY BLAZE GYM. THIS IS APPLICABLE TO ALL SERVICE OFFERED AT THE PREMISES. THE HEALTH COMMITMENT STATEMENT CAN BE SEEN HERE: https://www.blazegym.co.uk



MEMBERSHIP CHARGES & PAYMENT OPTIONS

ALL MEMBERS ARE LIABLE TO PAY ALL UPFRONT OR MONTHLY MEMBERSHIP FEES IRRESPECTIVE OF ACTUAL USAGE OF BLAZE GYM FACILITIES. MEMBERS MAY ELECT TO PAY THEIR MEMBERSHIP FEES IN MONTHLY DEFERRED PAYMENTS OR IN FULL.
MONTHLY DEFERRED PAYMENT PLANS ARE SUBJECT TO ROLLING CONTRACT TERMS WITH A DEFINED MINIMUM PERIOD.

IF PAYING MONTHLY, THE CONTRACT IS FOR A MINIMUM OF (THE PERIOD) DEPENDING ON MEMBERSHIP SELECTED. AFTER THE MINIMUM PERIOD, THE MEMBER WILL BE GIVEN THE OPPORTUNITY TO RENEW THEIR MEMBERSHIP FOR A FURTHER FIXED

PERIOD OF 1 MONTH, AND AFTER EACH FIXED PERIOD THEREAFTER. NOTE THAT THE PERIOD IS DEFINED BY THE NAME OF MEMBERSHIP


FOR EXAMPLE:
I. A ‘BLAZE SELF’ DE NOTES THE COMMITMENT TO A CLUB MEMBERSHIP FOR A MINIMUM THREE MONTHLY PAYMENTS PERIOD, VIA MONTHLY DEFERRED PAYMENT PLAN, BEFORE CONTINUING ON A MONTHLY ROLLING COMMITMENT.


II. ‘BLAZE STUDIO FLEXI’ RE DEFINED AS A ROLLING MEMBERSHIP WITH THE NEXT FULL MONTHLY PAYMENT DUE AS NOTICE OF CANCELLATION.


III. UPFRONT PAYMENTS COVER THE FULL TERM OF MEMBERSHIP AND ARE NON-REFUNDABLE.

 

*NOTE THAT CONTINUANCE OF MONTHLY PAYMENTS MADE TO BLAZE GYM AT THE END OF THE MINIMUM PERIOD, AND ANY FIXED PERIODS THEREAFTER, SHALL BE DEEMED TO CONSTITUTE RENEWAL OF THIS MEMBERSHIP AGREEMENT FOR A FURTHER FIXED PERIOD OF 1 MONTH AT THE PREVAILING RATE UNTIL WRITTEN NOTICE IS RECEIVED BY BLAZE GYM AND/OR THE COLLECTIONS AGENCY AT LEAST 1 CALENDAR MONTH PRIOR TO PROPOSED TERMINATION DATE. BLAZE GYM RESERVES THE RIGHT TO INCREASE MEMBERSHIP FEES ON A YEARLY BASIS. BLAZE GYM RESERVES THE RIGHT TO CHARGE A MEMBER VIA THEIR REGISTERED CARD FOR ANY MISSED PAYMENTS OR ANY UNAUTHORIZED CANCELLED MANDATES. THE MEMBERS CARD IS REGISTERED WITH BLAZE GYM DURING INITIAL SIGN-UP AND/OR PURCHASES MADE.


 
CANCELLATION AND CAUSES FOR EARLY TERMINATION
THE FOLLOWING REASONS MAY BE ACCEPTABLE TO BLAZE GYM SUBJECT TO FORMAL AGREEMENT FOR EARLY TERMINATION. TERMINATION REQUESTS WILL ONLY BE ACCEPTED AND APPLIED FROM THE DATE OF WRITTEN CORRESPONDENCE RECEIVED BY THE CLUB OR THE COLLECTIONS AGENCY. ILLNESS OR INJURY: LETTER FROM GP OR REFERRING DOCTOR REQUIRED.
RE-LOCATION: PROOF OF RELOCATION OUT OF THE AREA IS REQUIRED. BANKRUPTCY: PROOF REQUIRED.
WRITTEN CORRESPONDENCE MUST BE ADDRESSED TO FITNESS@BLAZEGYM.CO.UK. TO CANCEL A MONTHLY DEFERRED PAYMENT MEMBERSHIP, AN EMAIL MUST BE SENT TO FITNESS@BLAZEGYM.CO.UK REQUESTING TO DO SO. IF THE MINIMUM TERM HAS SURPASSED THEN ONE FURTHER FULL PAYMENT WILL BE TAKEN FROM THE DATE OF THIS CORRESPONDENCE. IF EARLY TERMINATION CRITERIA IS NOT MET THEN MONTHLY DEFERRED PAYMENT MEMBERSHIPS ARE SUBJECT TO ONE FULL PAYMENTS NOTICE FROM THE DATE OF THE CANCELLATION REQUEST POST MINIMUM TERM. ANNUAL UPFRONT MEMBERSHIP WILL RUN UNTIL THE ANNIVERSARY DATE. THIS MEMBERSHIP IS NON-REFUNDABLE AND WILL NOT RENEW WITHOUT PAYMENT.
UPFRONT MEMBERSHIPS ARE NON-REFUNDABLE. BLAZE GYM WORK WITH DEBT COLLECTING COMPANIES. FAILURE TO COMPLY WITH THESE PAYMENT RULES WOULD RESULT IN YOUR DETAILS BEING PASSED ON TO THE DEBT COLLECTING AGENCY AND WITH THE MEMBER PAYING FURTHER COSTS.
 
*. EXPULSION OF MEMBERS/GUESTS OR TERMINATION OF MEMBERSHIP BY BLAZE GYM.
BLAZE GYM MAY EXPEL MEMBERS/GUESTS OR MAY TERMINATE THE MEMBERSHIP OF ANY MEMBER: WITHOUT NOTICE AND WITH IMMEDIATE EFFECT IF THE MEMBER’S CONDUCT, WHETHER OR NOT SUCH CONDUCT IS THE SUBJECT OF A COMPLAINT BY
ANOTHER MEMBER OR GROUP OF MEMBERS, IS SUCH THAT IN THE REASONABLE OPINION OF BLAZE GYM, IT MAY BE INJURIOUS TO THE CHARACTER, NAME OR INTERESTS OF THE CLUB OR IS SUCH THAT IT RENDERS THE MEMBER UNFIT TO ASSOCIATE WITH OTHER MEMBERS OF BLAZE GYM.

BY NOTICE IN WRITING IF ANY PART OF THE ANNUAL MEMBERSHIP FEE OR MONTHLY MEMBERSHIP CHARGE WHICH IS DUE AND PAYABLE REMAINS UNPAID THIRTY DAYS AFTER THE DUE DATE FOR PAYMENT. LAPSES IN MEMBERSHIP PAYMENT WILL INCUR AN ADMINISTRATION CHARGE. A MEMBER WHOSE MEMBERSHIP IS TERMINATED BY BLAZE GYM SHALL FORFEIT ALL
PRIVILEGES OF MEMBERSHIP WITH IMMEDIATE EFFECT WITHOUT AN ENTITLEMENT TO ANY CLAIM FOR ANY REFUND OF THEIR PRODUCT FEE OR ANNUAL OR MONTHLY DEFERRED MEMBERSHIP FEE.
 
CLUB FACILITIES
CERTAIN CATEGORIES OF MEMBERSHIP DO NOT INCLUDE ALL OF BLAZE GYM’S SERVICES AND FACILITIES. SERVICES AND FACILITIES NOT SO INCLUDED MAY BE PROVIDED AT AN ADDITIONAL CHARGE AT BLAZE GYM’S DIS CREATION .MEMBERS WHO FAIL TO ATTEND PRE-BOOKED ACTIVITIES MAY BE CHARGED THE FULL STANDARD FEE FOR THE ACTIVITY IN QUESTION. BLAZE GYM RESERVES THE RIGHT TO MAKE REASONABLE ALTERATIONS TO THE TYPE OF FACILITIES PROVIDED WITHOUT NOTICE AND BLAZE GYM SHALL NOT BE LIABLE FOR ANY INCONVENIENCE CAUSED BY BUILDING WORKS AND FOR THE PROVISION OF ESSENTIAL MAINTENANCE SERVICES THAT OCCUR FOR 14 DAYS OR LESS, DUE TO MATTERS BEYOND OUR CONTROL OR IMPROVEMENT WORKS.

 
HOURS OF OPENING
INFORMATION IN RELATION TO BLAZE GYM’S NORMAL HOURS OF OPERATION AND THE OPENING HOURS OF THE FACILITIES ARE AVAILABLE FROM BLAZE GYM UPON REQUEST. SUCH HOURS MAY BE LENGTHENED OR SHORTENED AT THE ABSOLUTE DISCRETION OF BLAZE GYM WITH OR WITHOUT ANY PRIOR NOTICE BEING GIVEN TO MEMBERS. BLAZE GYM SHALL ENDEAVOUR TO GIVE MEMBERS REASONABLE NOTICE OF CHANGE TO SUCH HOURS.

ON OCCASIONS WHEN NECESSARY MAINTENANCE IS REQUIRED, BLAZE GYM, OR PARTS THEREOF, MAY BE CLOSED. ANY REFUND GIVEN AS A RESULT OF CLOSURE WILL ONLY BE MADE AT THE SOLE DISCRETION OF THE DIRECTOR OR MANAGER.
 
NOTICE AND MEMBERSHIP CORRESPONDENCE
ALL MEMBERSHIP RELATED CORRESPONDENCE, INCLUDING CANCELLATION AND FREEZE REQUESTS, MUST BE SENT TO THE EMAIL FITNESS@BLAZEGYM.CO.UK. THE EMAIL WILL BE TIMESTAMPED. THE CLUB WILL ENDEAVOUR TO RESPOND WITHIN 5 WORKING DAYS.


MEMBERSHIP FREEZE

MEMBERSHIP FREEZES ARE AT THE DISCREATION OF BLAZE GYM. A CHARGE WILL BE APPLICABLE FOR ALL FREEZES.


PERSONAL TRAINING

BLAZE GYM DOES NOT OFFER PERSONAL TRAINING SERVICE. ANY FORM OF PERSONAL TRAINING PURCHASED IS BETWEEN THE MEMBER AND THE PERSONAL TRAINER. BLAZE GYM WILL NOT BE RESPONSIBLE FOR ANY INJURY/DAMAGE/LOSS OF ANY KIND, DURING/AFTER ANY PERSONAL TRAINING SESSION. ALL PAYMENTS FOR PERSONAL TRAINING SESSION IS BETWEEN THE MEMBER AND THE PERSONAL TRAINER. BLAZE GYM WILL NOT BE LIABLE FOR ANY REFUNDS ON THESE PERSONAL TRAINING
SESSIONS PURCHASED. ANYONE TAKING PART IN ANY FORM OF PERSONAL TRAINING AT BLAZE GYM MUST ENSURE THEY COMPLY AND UNDERSTAND ALL TERMS AND CONDITIONS SET OUT HERE.

CLASSES

BLAZE GYM HAS THE RIGHT TO CHANGE THE CLASS TIMETABLE AT ANY GIVEN TIME OR CANCEL ALL CLASSES PERMANENTLY. CLASSES MAY BE CHANGED/REMOVED OR COMPLETELY CANCELLED. MEMBERS WILL BE NOTIFIED ON BEST EFFORTS. MEMBERS NEED TO ABIDE BY THE CLASS RULES WHICH HAVE BEEN SET WITHIN THE CLUB, FAILURE TO DO SO COULD MEAN A BAN BOOKING ON TO FUTURE CLASSES OR MEMBERSHIP BEING CANCELLED PERMANENTLY.

Collection of Visitor Information on this Site

Any information collected at the Sites is governed by our Privacy Policy, unless otherwise stated. To access and use certain services available through the Sites, you may be required to register with EK (Essex) Ltd T/A Blaze Gym through a login/registration page and you must agree to be bound by any additional applicable terms and conditions contained there.
 

Copyright

All content, software, and technology included on the Sites or used in the operation of the Sites is the owned or licensed property of EK (Essex) Ltd T/A Blaze Gym or its content, software, and technology suppliers, and is protected by copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content on the Sites is the exclusive property of EK (Essex) Ltd T/A Blaze Gym.  EK (Essex) Ltd T/A Blaze Gym grants you permission to view and use content, software, and technology made available to you on the Sites in connection with your own personal, noncommercial use of the Sites. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content, software, and technology on the Sites is strictly prohibited.

Other Intellectual Property

All other intellectual property rights related to the content, software, and technology included on the Sites or used in the operation of the Sites, including without limitation, patents, trade secrets, trade dress, publicity rights, character rights, titles, and artistic and moral rights are the owned or licensed property of EK (Essex) Ltd T/A Blaze Gym. Any use of these rights without the prior written permission of EK (Essex) Ltd T/A Blaze Gym is strictly prohibited.
 

Accuracy

Information on the Sites may contain typographical errors, inaccuracies, or omissions in relation to services, pricing, locations, descriptions, information, and other matters. EK (Essex) Ltd T/A Blaze Gym reserves the right to correct any errors, inaccuracies, or omissions and to discontinue, change or update information at any time without prior notice. If EK (Essex) Ltd T/A Blaze Gym discovers price errors, they will be corrected on EK (Essex) Ltd T/A Blaze Gym’s systems, and the corrected price will apply to your order.

THE SITES AND ALL CONTENT, MATERIALS, PRODUCTS AND SERVICES AVAILABLE THROUGH THE SITES ARE PROVIDED ON AN “AS IS, WITH ALL DEFECTS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE.  BLAZE GYM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, NON-INFRINGEMENT, AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, ACCURACY OF INFORMATIONAL CONTENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR USAGE OF TRADE. BLAZE GYM MAKES NO REPRESENTATION THAT THE SITES OR ANY CONTENT IS FREE FROM ERRORS, VIRUSES, BUGS, OR OTHER HARMFUL COMPONENTS. BLAZE GYM MAKES NO REPRESENTATION OR WARRANTY THAT CONTENT PROVIDED ON THE SITES IS APPLICABLE OR APPROPRIATE FOR USE IN LOCATIONS OUTSIDE OF THE UNITED KINGDOM. NOTHING IN THESE TERMS OF USE OR IN ANY ORAL OR WRITTEN DESCRIPTION OF THE SITES WILL CONSTITUTE A REPRESENTATION OR WARRANTY WITH RESPECT TO THE SITES.
 

YOU ACKNOWLEDGE, BY YOUR USE OF THE SITES, THAT SUCH USE IS AT YOUR SOLE RISK.
 

Limitation of Liability

IN NO EVENT SHALL EITHER BLAZE GYM, NOR EK ESSEX LTD, BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITES OR THE SERVICES AVAILABLE THROUGH THE SITES, WHETHER BASED ON CONTRACT, TORT, WARRANTY, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES.

Under no circumstances whatsoever shall EK (Essex) Ltd T/A Blaze Gym’s aggregate liability resulting from or relating to your use of the Sites exceed FIVE POUNDS (£5.00).

THE MEMBER ACKNOWLEDGES THAT BLAZE GYM’S OBLIGATIONS AND LIABILITIES IN RESPECT OF BLAZE GYM ARE DEFINED IN THIS AGREEMENT AND/OR WITHIN THE REGULATIONS APPLICABLE TO ALL USERS.
THE MEMBER IS RESPONSIBLE FOR THE CONSEQUENCES OF ANY USE OF ANY OF THE FACILITIES OF BLAZE GYM. BLAZE GYM WILL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSS, DAMAGE, COSTS, EXPENSES, THEFT OR DAMAGE TO PROPERTY, WHETHER ARISING UNDER CONTRACT, OR OTHERWISE.
 

Prohibited Activities and Visitor Obligations

As a visitor or user of the Sites you shall not:

  • violate any applicable law or regulation;

  • upload, post, use, transmit, or otherwise make available, including by e-mail, (each, a “Post”) any content or information that is false or inaccurate;

  • Post any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or content that could otherwise be considered to be objectionable;

  • impersonate or use the identity of another person or organization, or falsely state or otherwise misrepresent your affiliation with a person or organization;

  • engage in any activities or manipulate identifying material to misrepresent the origin of content;

  • Post any content that is subject to any disclosure restrictions;

  • Post any materials, items, information or content that infringes or otherwise violates any patent, copyright, trademark, or any other intellectual property rights;

  • Post any unsolicited or unauthorized advertising or promotional materials, including without limitation, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;

  • use the Site to disseminate any information or content, including by e-mail, that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, or information or content that could otherwise be considered to be objectionable;

  • Post any material that contains software viruses or any other corrupt computer code, files or programs that impair the use of any computer software or hardware or telecommunications equipment;

  • interfere with or otherwise limit the use of the Sites by other users; or collect, compile, or store personal information about other users of the Sites;

  • disrupt or interfere with the operation of the Sites by overloading or exceeding the capacity of the Sites or the systems resources; accounts; usernames and passwords; servers; or networks connected to or accessible through the Sites or any affiliated or linked sites;

  • disrupt or interfere with the security of, or otherwise cause harm to, the Sites or the systems resources; accounts; usernames and passwords; servers; or networks connected to or accessible through the Sites or any affiliated or linked sites;

  • use any robot, spider, other automatic device, or manual process to “screen scrape,” monitor, “mine,” or copy the web pages on the Sites or the content contained therein without EK (Essex) Ltd T/A Blaze Gym’s prior, express, and written permission; or

  • use the Sites for commercial purposes.
     

You agree that you are solely responsible for the Post of any content that you make available on or send through the Sites (“User Content”). In addition to the rights granted to EK (Essex) Ltd T/A Blaze Gym elsewhere in these Terms of Use, you hereby grant EK (Essex) Ltd T/A Blaze Gym the irrevocable right to copy and use User Content in connection with the Sites and for the purposes related to your Post of the User Content. Although EK (Essex) Ltd T/A Blaze Gym has no obligation to screen, edit or monitor any of the User Content or user conduct on the Sites, EK (Essex) Ltd T/A Blaze Gym reserves the right, and has absolute discretion to remove, screen or edit any User Content and to monitor any user conduct on the Sites at any time and for any reason without notice. Your User Content may be available on the Sites for a limited period of time, as determined by EK (Essex) Ltd T/A Blaze Gym in its sole discretion. You are solely responsible for creating backup copies and replacing any of your User Content at your sole cost and expense.

By the Post of User Content to the Sites, you represent and warrant that (a) the User Content is non-confidential is not subject to disclosure restrictions under any applicable data privacy laws or regulations; (b) you have all necessary rights to Post the User Content to the Sites and to grant the rights to EK (Essex) Ltd T/A Blaze Gym you grant in these Terms of Use; (c) the User Content is accurate and not misleading or harmful in any manner; (d) the User Content, and your use and the Post thereof in connection with the Sites, does not and will not violate these Terms of Use or any applicable local, state, national or international statute, regulation, or law.
 

Indemnification

You agree to indemnify, defend, and hold EK (Essex) Ltd T/A Blaze Gym and its successors and assigns harmless from and against and in respect of any and all third party claims, demands, losses, costs, expenses, obligations, liabilities, damages, recoveries, and deficiencies, including interest, penalties, and reasonable attorneys’ fees that EK (Essex) Ltd T/A Blaze Gym incurs or suffers which relate to your use of the Sites, your failure to perform any of your obligations under these Terms of Use, or your breach of any of your representations or warranties made under these Terms of Use.

Links to Other Web Sites

The Sites may contain links to other web sites. Additionally, other web sites may contain links to the Sites. EK (Essex) Ltd T/A Blaze Gym does not review or monitor the web sites linked to the Sites and EK (Essex) Ltd T/A Blaze Gym is not responsible for the content or policies of any other web sites. Your Account

If you are a registered user of any of the Sites, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. EK (Essex) Ltd T/A Blaze Gym reserves the right, without notice and in its sole discretion, to refuse or restrict access or service, terminate accounts, or remove or edit content.
 

Payment

You authorize EK (Essex) Ltd T/A Blaze Gym and any payment processing service provider it may engage to charge your credit card, or to debit or process payment through any other offered means, for any products or services you purchase through your use of the Sites. You represent and warrant that you are the only one who will make payments in connection with the Sites, and you shall be responsible for any and all uses of your credit card, debit card, or any other payment means used in or under your name.  Unless otherwise specified, any amounts paid to EK (Essex) Ltd T/A Blaze Gym are nonrefundable.
 

Employees, Trainers or Other Contractors

THIS SECTION OF THESE TERMS OF USE APPLY ONLY IF YOU ARE A BLAZE GYM EMPLOYEE, OUTSIDE TRAINER OR OTHER CONTRACTOR WHO IS ALSO PROVIDED WITH ACCESS TO THE DATA OF OTHER USERS.

You may use your ability to access data applicable to other persons (“Member Data”), and use the Member Data that is disclosed to you, solely for the purposes of providing assistance to the other person in that person’s use of the Sites or BLAZE GYM Club facilities or services. You must take all reasonable measures to prevent Member Data from being exposed or disclosed to others. You may not disclose any Member Data to any other person without the prior consent of EK (Essex) Ltd T/A Blaze Gym. You acknowledge that in the event any Member Data in your possession or control is exposed or disclosed without authority, whether by your fault or not, EK (Essex) Ltd T/A Blaze Gym may be required to give notice of such exposure to the affected members and to law enforcement authorities. You will be deemed responsible for any losses suffered by EK (Essex) Ltd T/A Blaze Gym or by a member which are caused by your negligent, intentional, or malicious acts regarding violation of your obligations in this paragraph. 
 

General Provisions

English has been used in the preparation of these Terms of Use, and English shall be the controlling language with respect to these Terms of Use and their interpretation.
 

Any failure by EK (Essex) Ltd T/A Blaze Gym to enforce any provision of these Terms of Use shall not be construed as a waiver of any provision or the right to enforce same.
 

You are responsible for compliance with applicable laws.
 

Submissions

Any and all questions, comments, suggestions, and similar materials or information that you send or submit to EK (Essex) Ltd T/A Blaze Gym or a third party provider on the Sites, by a Post or otherwise (collectively, “Submissions”), shall become EK (Essex) Ltd T/A Blaze Gym’s property; and you hereby transfer, sell, and assign to EK (Essex) Ltd T/A Blaze Gym all of your right, title, and interest in and to any such Submissions, including without limitation, any and all related patent, copyright, trademark, and other intellectual property rights. EK (Essex) Ltd T/A Blaze Gym has no obligation of any kind whatsoever to maintain any confidentiality with respect to any such Submissions. EK (Essex) Ltd T/A Blaze Gym shall be free to use them for any purpose whatsoever without providing you notice or receiving your consent and without restriction or compensation.
 

General Club Rules

  • Respect other's personal space

  • Please use the lockers: No bags/coats allowed on the Gym Floor, Studio or Functional Area

  • Please put your weights back

  • Please clean up after yourself

  • Please don’t drop weights or slam the machine weights

  • No Chalk allowed

  • Do not leave items in the lockers overnight.

  • Please do not take equipment between floors or out of the building

  • No muddy shoes

  • Wipe Equipment before and after use

  • No food or drink, except water, on either floors

  • Take care of the equipment.
